General Terms of Use:
By signing up for this event you acknowledge and agree to all of the terms and conditions for use of this site as well as to adhere to the policies pertaining to your booking. If you do not agree with or object to any part of the terms and conditions, you should not use this site, because by your use you waive any objection to any term or condition contained herein. Your use of this site is subject to the terms and conditions set out below, and all applicable international, federal, provincial and local laws and regulations. These terms and conditions limit and exclude our liability. Your legal recourse for liability arising from your use of this site will generally be limited to claims against third party service providers.
Changes to Site and Terms & Conditions:
Footprint Adventures Inc. may at any time modify these terms and conditions and your continued use of this site will be subject to the terms and conditions in force at the time of your use. Footprint Adventures Inc. is under no obligation to update any content on the site. Footprint Adventures Inc. may change the content on the site at any time without notice. Footprint Adventures Inc. may make improvements or changes to the site at any time.
Footprint Adventures Inc. reserves the right to correct any pricing errors on our website and/or on pending reservations made under an incorrect price. In such event, we will offer you the opportunity to keep your pending reservation at the correct price or, at your option, we will cancel your reservation without penalty.
Footprint Adventures Inc. reserves the right to cancel or alter any travel service herein presented, at its discretion. In the event that an acceptable alternative cannot be found, Footprint Adventures Inc.’s only liability will be to refund all monies paid as it cannot assume responsibility or liability for any claims, loss or delay, disappointment, distress or frustration, whether physical or mental, resulting from any act or omission by Footprint Adventure Inc, their employees, or any person or persons collaborating with them.
Footprint Adventures Inc. is under no obligation to update any content on the site. Although care has been taken in preparing the information supplied on this web server, Footprint Adventures Inc. does not and cannot guarantee the accuracy of it, therefore they cannot accept liability for errors, omission and inaccuracies.
Minimum Age for Use and Legal Responsibilities:
You represent that you are not a minor, are at least the age or majority and have legal capacity to use this site and to create binding legal obligations for any liability you may incur as a result of booking through Footprint Adventures Inc. You understand that you are financially responsible for all uses of this site by you and those using your login information. If you use this site, you are responsible for maintaining the confidentially of your account information and your password. You agree to accept responsibility for all activities that occur under your account or password.
Reserving Your Trip:
Reserving you excursion or event with Footprint Adventures Inc. is easy. Just call 1-250-217-3465, e-mail your request to info@footprintadventures.ca or reserve your trip on the web through our real-time online reservation system. If you’re not sure if a particular trip is right for you or you’re looking for more information, let us know and we will advise on the trips to help you find one suitable for you. You must clearly state all your requirements at the time of booking. If you want to change any aspect of your booking including but not limited to a change to a trip of shorter duration or different departure date you must notify us as soon as possible in writing. We will do our best to accommodate your requested changes but you will be required to pay an amendment fee to cover administrative costs up to $75.
To reserve space on any trip, deposit is due within 72 hours of booking any trip or event. Please see event description for deposit amount. The deposit is non refundable unless your trip has been cancelled. For any trips under $100 full payment of the event is due at time of booking.
Deposit and Full Payment can be made by cash, check or money order and for all trips we accept payment through PayPal using Visa, MasterCard, American Express. If invoiced amount is paid in-full within 5 business days 2% of the invoiced amount will become a creditable amount usable towards any future adventure with Footprint Adventures Inc. within 6 months from the date of purchase.
Final balance of the invoice outstanding is due within 30 days of invoiced date unless other requirements are specified in the event description. If invoice balance is not paid in full prior to 30 days of departure date your deposit and booking reservation is forfeit.
Cancellations and Refunds:
If you find it necessary to cancel your trip, please notify us as soon as possible. Written notice of your cancellation is required. Cancellation penalties can range up to 100%, depending upon the date you cancel and the trip you are cancelling. We regret we cannot make exceptions for personal emergencies. Cancellation or Modification by Footprint Adventures Inc.:
Every effort will be made to operate all trips as advertised but it must be remembered that our trips are planned up to twelve months in advance. We therefore reserve the sole right, at our discretion, to modify or cancel any trip, flight schedule, accommodation or arrangement at any time. We will notify you as soon as possible of any changes and they will form part of our contract with you. In the case of any material modification or cancellation, we will, if possible, provide you with three alternatives:
(1) a trip of an equivalent or closely similar standard and price, if available;
(2) a trip of a lower standard together with a refund of the difference in price; or
(3) cancellation with a full refund of all monies paid.
Insurance:
Although our intention is for a safe trip for all, we strongly recommend that you protect yourself, your belongings, and your vacation through the purchase of a short-term traveler’s policy. A trip cancellation policy covers your non-refundable payments in most cases, should you have to cancel your trip at the last minute due to illness or injury. Trip participants should realize that in the event of illness or injury on a river trip, evacuation can be prolonged, difficult and expensive. Baggage and cameras are carried entirely at the owner’s risk, and we accept no responsibility for lost, damaged or delayed property.
Liability Waiver:
Everyone is required to sign a standard liability release or acknowledgement before the trip, acknowledging awareness and acceptance of some risks associated with the trip.
Medical:
Although there are few prerequisites for joining a Footprint Adventures Inc. trip, weight restrictions may apply, and being healthy certainly makes the experience more rewarding. People with heart trouble and pregnant women should have a physician’s approval before engaging a trip. Persons with various disabilities are welcome on Footprint Adventure trips, pending a discussion of any special requirements.
You will not be permitted to commence or continue on the trip if your mental or physical condition is, in the reasonable opinion of any representative of Footprint Adventures Inc., such as to render you incapable of caring for yourself, or whereby you become objectionable to other passengers, or you become a hazard to yourself or other passengers. We will not be responsible for expenses resulting in you being precluded from completing the trip for any reason, nor will we refund you any part of your trip cost. In all cases we will notify you of the reasons why we have taken this action. We will have no obligation to arrange for your return to the point of the trip departure where your condition manifests itself after the trip departure. Further, if the trip involves travel by air, the captain of your aircraft can refuse to allow you to fly on the aircraft if he believes that you could be dangerous or disruptive to other passengers on the flight.
Travel Documents:
Please ensure you read your invoice, tickets and all documents carefully and notify us immediately if any information appears to be incorrect. We will not accept any liability if you fail to notify us of any inaccuracy in any document within 14 days of us sending them to you. While we will do our best to rectify any changes made outside this time, it is your responsibility to meet any additional costs which may be involved, except in the case of an error made by Footprint Adventures Inc. and where there is reasonable justification for you not contacting us within the specified time determined at the sole discretion of Footprint Adventures Inc. You are responsible for ensuring that all necessary travel documents including, but not limited to, passports, visas and vaccination certificates are valid and subsisting. We strongly recommend that you verify current documentation requirements and all other relevant protocols and procedures associated with your trip with us. Please note requirements change and you must check with your Consulate for the most up to date information. Passports must have an expiry date of at least six months after completion of the trip.
Tipping:
Our guides work very hard to please you and provide an excellent experience. They appreciate whatever feedback you care to give them, including a gratuity if you so desire.
Storage of Personal and Financial Information:
Due to the nature of our product, it is necessary to collect and store a certain amount of personal and financial information. By providing us with address, personal and financial information, you consent to the storage of this information for a period of time deemed appropriate by Footprint Adventures Inc.
Personal information includes, but is not limited to, your first name, last name, phone number, email address and billing address. Financial information includes, but is not limited to, your card account number, card expiration date and cardholder name.
